    Guidelines and restrictions for the developement of Section A and Section B

    Section A (Above Whitehill Ave, North Sunshine)
    i. Consent of all lot owners from corner Whitehill Ave and Auburn Ave to Lot 7.
    ii. Each lot owner has to pay $136,500 to Glen Ora Estate Pty Ltd upon obtaining a certificate of compliance from City of Brimbank.

    Section B (Above Whitehill Ave, North Sunshine)
    i. 90% of the land owners in Section B have to agree to pay Glen Ora Estate Pty Ltd a sum of $136,500 upon obtaining a certificate of compliance with City of Brimbank.
    ii. Agreement has to be reach with Glen Ora Estate Pty Ltd by no later than 1 November 2020. If no agreement is reached prior to that date then Glen Ora Estate will require 100% of all the lot owners in Section B.

    Condition applying to both Section A and Section B
    i. All lot owners within Section A and Section B are required to comply with Schedule 3 to the environmental significance overlay. *See map.
    ii. All lot owner will be required to comply with the planning provision with City of Brimbank in particular no building permit can be issue unless all lots are fully serviced.
    iii. Subject to the lot owners entering into an agreement with Glen Ora Estate Pty Ltd. Glen Ora Estate will seek consent from the Commonwealth Minister for the Environment to obtain a variation of the Strategic assessment agreement between the Commonwealth and Glen Ora Estate Pty Ltd to enable the removal of matters of national significance from the said lots.
    iv. In the event that no agreement can be reached with the prescribed percentage of lot owners, Glen Ora will not seek consent from the Commonwealth Minister for the environment for the removal of matters of national significance from the land.
    v. Possible resolution if lot owners in Section B do not have the funds to develop. All lot owners should consider reaching an unanimous agreement to place on the market all their lots as a single holding. This would alleviate the need for individual lot owner to fund the infrastructure charge for their respective lots. There are 25 lots with a land area of 1.7ha.

    Current Outstanding Drainage Issue
    It is expected that Glen Ora Estate Pty Ltd will lodge with the City of Brimbank a document called "STORMWATER MANAGEMENT STRATEGY REPORT". Unresolved matter relates to the ownership of stormwater drain that was aproved of by the City of Sunshine in 19 December 1966 and built on land belonging to Glen Ora Estate Pty Ltd to Somers st and Douglas St in Sunshine. See enclosed map showing ManHoles 1 to 7. Glen Ora Estate Pty Ltd is claiming ownership of that drainage pipe. The City of Sunshine disputes the claim by Glen Ora.

    Commencment of works

    Glen Ora has commenced construction works in respect of the sewage and water. Boring will be undertaken within the next 30 days at the end of Munro Ave for the purposes of a proposed pipeline from Knight Ave to Munro Ave for the supply of water. Test drilling has also commenced in land adjoining Bunnett St and Lance Rd.
    In view of the substantial increase of labour and materials Glen Ora has found it necessary to charge an infrastructure charge of $200,000 plus GST per lot which will be applicable from the first of July 2022 to 30 June 2023.

  1. Recent Construction Cost: Based upon recent cost of construction of infrastructure and offsets, any lot owner wishing to proceed should assume that the cost for next 12 months per lot payable to the Developer shall be $245,000 plus GST. Any person who does not participate or agree to pay these charges shall be liable for a sum equal to 4% per annum on the sum of $245,000 plus GST and compounded based upon the Commonwealth Personal Loan applicable on the date Certificate of Satisfactory Completion issued by Brimbank Council in respect of Drainage and relevant authority with Certificate of Satisfactory Completion of works from PowerCor, Greater Western Water (GWW) and NBN.
    Once the project is completed in the relevant stage in the 9-stage plan and the relevant Certificates are issued as described above, there shall be annual charge to lot owners equal to 0.85% of the last Council rate notice. The amount payable shall be paid into a separate bank account for the sole purpose for the annual maintenance for roads, drainage, public lighting, maintenance of electricity meters, general switch board, maintenance of the transformers together with a depreciation allowance for the transformers. Lot owners will also be liable for normal Council rates and charges imposed by GWW. The development will proceed on a 9-stage plan and will be in accordance with the agreement of the majority lot owners in each stage.

  2. Rail Projects Victoria: Rail Project Victoria has issued in the past 7 months a notice for compulsory leasing on part of Munro Avenue. There is a dispute between the parties on the quantum of rental and the first hearing of that dispute is on the 6th September 2023. Rail Projects Victoria entered possession in Munro Avenue on the 24 January 2023 and have paid no rent. A notice of compulsory acquisition was issued on 3 March 2023 in respect of part of the property in West Avenue and Burwood Avenue. No monies have been paid by Rail Projects Victoria in respect of this acquisition. We have no idea when we are to be paid and what we are to be paid and we have no idea how long Rail Projects Victoria will be in Munro Avenue. In essence we have not received any monies from Rail Projects Victoria or the Victorian Government. Rail Projects Victoria have cleared part of Munro Avenue of Native Vegetation and have now constructed a road for their use.

  3. Strategic Assessment Agreement: Commencing from the 1 September 2023 and finishing in December 2023, Glen Ora have arranged for what is hoped to be the last Survey for Striped Legless Lizard, Golden Sun Moth and Native grasses. Once that survey is finished, the Commonwealth should then be in a position to give us what conditions of any to permit the development to commence internally.  

Embedded network: It is purposed that there would be private embedded network administered by either Glen Ora Estate or one of the major power companies. To achieve this, Glen Ora Estate requires the consent of Energy Safe Victoria (ESV) and AER. Glen Ora has obtained already the consent from ESV and is in the process of applying for a private embedded licence from AER.

Lot owners needs to be very clear what is proposed is that if they do not pay the current infrastructure charge as set out above to the satisfaction of Glen Ora, then Glen Ora will not commence to access the electrical infrastructure in the road. PowerCor requires each lot to have 3-phase power and 14kVa as a minimum. In essence we will not be permitting “Free Loaders” to connect into the network. Monitoring systems will be in place to check for any power leakages so as to prevent a theft of electricity from the network.

There have been numerous discussions with proposed purchases of the Roads including some of the lot owners and third parties. As of the time of writing this note, no agreement has been reached with any parties and unless such an agreement is reached within the next 14 days, Glen Ora Estate Pty Ltd will give serious consideration of applying for a Bio Diversity Certificate pursuant to the provisions of the Nature Repair Act 2023. A number of lot owners have been advised of this matter. The grant of that certificate will not affect the rights of any lot owners to access their lots or interfere with their rights to use the roads to exit the land. It is advisable to all lot owners to seek independent legal advice regarding this matter.
